Spring Management Conference Offers Speakers, Events

The Spring Management Conference, May 11-13 in Boca Raton, Fla., will offer an array of speakers and events, including a flip-flops-encouraged President's Welcome Reception.

The SMC kicks off with a First-Timers' Reception at 5 p.m. on Thursday May 11, followed immediately by the President's Welcome at the Boca Raton Resort and Club pool. "Generation Next, Part Two," will discuss dealing with the next generation of customers in ways that they prefer. Retired Air Force Col. Kelly Latimer, now a pilot for Virgin Galactic, will be the guest speaker for the Women of Gases and Welding luncheon.

The Contact Booth Program, an unparalleled opportunity for suppliers and distributors to meet each other and learn how they can work together to succeed, will run from 1 p.m. to 4:30 p.m. on Friday, May 12.

GAWDA Joins Letter to DOT Secretary Chao on SFD Rulemaking

GAWDA has joined a group of associations and motor carriers in a letter to Transportation Secretary Elaine Chao asking DOT to rescind the Federal Motor Carrier Safety Administration’s proposed rule on safety fitness determinations. Instead, the coalition asks the Department to work with the National Academy of Sciences to reform the process that underlies the proposed rule.
The coalition, which includes the American Trucking Associations and the Owner-Operator Independent Drivers Association as well as many other shipper, truck and bus interests, asserts that that the new proposed methodology uses flawed Compliance, Safety and Accountability (CSA) program/Safety Measurement System (SMS) data and scores.
Congress directed the agency to review and reform the CSA/SMS methodology just months earlier in the Fixing America’s Surface Transportation Systems Act (FAST Act) enacted in December of 2015. Those reforms are in process with initiation of a study by the National Academy of Sciences and their final report is expected in June of this year.
Public Citizen Challenges 2-for-1 Regulatory Reform Order in Court

Public Citizen, the Natural Resources Defense Council and the Communications Workers of America have filed a lawsuit in the U.S. District Court for the District of Columbia seeking to overturn President Trump’s January 30 Executive Order that directs federal agencies to repeal two federal regulations for every new rule they issue.

The suit is filed against the president, the acting director of the Office of Management and Budget and the current or acting secretaries and directors of more than a dozen executive departments and agencies. The complaint alleges that the agencies cannot lawfully comply with the president’s order because doing so would violate the statutes under which the agencies operate and the Administrative Procedure Act.

The Executive Order directs federal agencies to identify at least two existing regulations to be repealed for each new regulation proposed. The order will be in effect through fiscal year 2017, which ends September 30, 2017.

Additionally, the order states that “the heads of all agencies are directed that the total incremental cost of all new regulations, including repealed regulations, to be finalized this year shall be no greater than zero, unless otherwise required by law or consistent with advice provided in writing by the director of the Office of Management and Budget.” Moreover, “any new incremental costs associated with new regulations shall, to the extent permitted by law, be offset by the elimination of existing costs associated with at least two prior regulations.”
