Attorney James Payne will defend suspect in federal gang-related kidnapping of NC prosecutor's father

SHALLOTTE, NC (NEWS RELEASE) -- Criminal Defense Attorney, W. James Payne, was appointed on May 7, 2014, to defend Jakym Camel Tibbs, a Defendant in the Federal Kidnapping case (USA vs. Melton; 5:14-cr-72-D-3) in North Carolina.

“Last week, the U.S. Department of Justice charged Tibbs and Quantavious Thompson - who was arrested on Wednesday - with conspiracy to kidnap 63-year-old Frank Janssen from his home in Wake Forest, N.C., on April 5. The victim was rescued on April 9 when FBI agents raided the Atlanta apartment where he was being held. Authorities told WSPA that the crime was related to Janssen's daughter, a prosecutor who helped put away high-ranking Bloods street gang member Kelvin Melton. Melton, 49, who is from New York City, is serving a life sentence for ordering the shooting of a man in 2011; he was convicted of being a habitual felon, and assault with a deadly weapon with intent to kill.” (CBS NEWS)

Jakym Camel Tibbs’s Arraignment is scheduled for the June 30, 2014. This will be held in front of Chief Judge James C. Dever III.

How does a convicted murderer go free?

WILMINGTON, NC (WWAY)-- No one saw this coming. Just when we thought there were answers, the search for Shannon Rippy continues on.

Wilmington Police Chief Ralph Evangelous said Thursday that a body found in Pender County Tuesday turned out not to be the body of Rippy.

However, the suspect remains the same. James Bradley is still facing charges of first degree murder and is still the prime suspect in Rippy’s murder. With another body found, he’s now the suspect in another murder. And, murder is a term that Bradley is unfamiliar with.

“Life without parole means life without parole,” said James Payne, a local defense attorney, explaining though that it did not when James Bradley was initially sentenced for the murder of his 8-year-old stepdaughter.

Hanged for Money Laundering

 

In what universe does defending a client in a money laundering case equal the same stakes as defending a client in a capital murder case?  As you may know, a capital murder case is a first degree murder prosecution in which the state or government seeks to put a Defendant to death--at least in the United States.  Believe it or not, those same life-saving skills of the criminal defense attorney may be called upon to preserve the life of a banker charged with bank fraud or money laundering--at least in Iran.  As a white collar criminal defense attorney with many additional years of experience defending capital murder cases, I was shocked to read about the HANGING of a banker--but then I read it was Iran. 

 

Mahafarid Amir Khosravi met this fate in late May 2014, after an Iranian court convicted him of over $2 billion in bank fraud and money laundering charges.  This draconian measure by no means minimizes the harsh penalties white collar criminal defendants face here in the United States.  Hopefully the recent movement to reduce the sentences in federal court for financial crimes will see fruition soon.
