The team at Lathan & Watkins reports that the restructuring market’s appetite for Part 26 schemes of arrangement and Part 26A restructuring plans shows no signs of diminishing despite concerns around Brexit turbulence and predicts that the mature jurisprudence coupled with the new power to cram-down will ensure that the English scheme and plan will remain the preferred restructuring tools of choice for many larger debtors in Schemes and Restructuring Plans: Where Are We Now?
James Hillman of PinsentMasons notes that firms wishing to provide or sell pre-paid funeral plans in the UK will need to be authorised by the FCA by 29 July 2022 and summarises the new rules that insolvency practitioners need to comply with if they are appointed over such businesses in Regulation of pre-paid funeral plan providers: issues for UK insolvency practitioners.
JonBramwell of Grant Thornton reports that ESG credentials are starting to factor into lenders' credit risk assessments for mid-market firms and warns that companies without an ESG roadmap in place may not enjoy the same access to capital in five years in ESG lending: momentum is building for the mid-market.
