Use Your Bankruptcy Rights During the Economic Slowdown

With millions unemployed as a result of the Covid-19 pandemic, we are fortunate to have a federal right to declare bankruptcy. Some lenders are granting leniency and deferring payments for a month or two, but others have been more aggressive as the payments slow.

In Carter, Washington, and Sullivan Counties in Tennessee, lawsuit filings for overdue medical, credit card, and personal loan debts have continued. With the economic slowdown, this is bad news for debtors.

Now more than ever should Bankruptcy be a real consideration. It is spelled out in the Constitution and has been a federal institution since 1800.

Good news for Chapter 13 filers

The CARES Act response to Covid-19 grants individuals $1,200 plus $500 per dependent child. This led to the question whether Chapter 13 filers are required to pay this into their plan.

A short section in the act explicitly says it is not. Chapter 13 filers like those outside bankruptcy can keep their stimulus check.
